Georgia Biomedical Waste Regulations

In Georgia, medical waste is regulated as biomedical waste by the Georgia Environmental Protection Division (EPD), under Rule 391-3-4-.15 of the state’s Solid Waste Management Rules, with the Georgia Department of Public Health and county health departments providing additional oversight. A few requirements shape how every Georgia generator must operate:

• The 100-pound threshold. Facilities generating less than 100 pounds of biomedical waste per month are partially exempt, but those at or above 100 pounds per month must meet Georgia’s full registration, reporting, and recordkeeping requirements. Knowing which side of that line your facility falls on is the first compliance question.
• A 30-day storage limit. Biomedical waste must be removed within 30 days of the first non-sharps item being placed in a container; for sharps-only containers, the clock starts when the container is sealed.
• Treatment before disposal. Biomedical waste must be rendered noninfectious by steam sterilization or incineration at a permitted facility, with pathological and chemotherapy waste requiring incineration. Landfilling untreated biomedical waste from regulated generators is prohibited.
• Permitted transport. Generators may transfer waste only to a collector operating under Georgia’s rules, with proper containment and manifesting.
